El propósito de esta contribución es demostrar el aporte del pensarniento hobbesiano a la idea de la igualdad entre hombres y mujeres, y confrontarlo con el de su objetor B. Spinoza. En sus obras Elements of law y De Cive, Thomas Hobbes va a cuestionar la autoridad patriarcal y la desigualdad entre hombres y mujeres como expresión de una ley de la naturaleza. Por el contrario, va hablar del carácter convencional de la sujeción de las mujeres y va a exponer (...) que la familia funciona bajo la misma regla de operación de los estados, mediante el pacto. Este aparte hobbesiano parece haber reunido poca resonancia entre los filósofos posteriores, pues el único que lo tuvo en cuenta para contravenirlo fue B. Spinoza. Spinoza combatió el punto de partida hobbesiano de que la desigualdad existente entre hombres y mujeres es producto de una convención o acuerdo. Pero, tal vez a su pesar, convino que son la educación y la cultura los agentes de dicha diferenciación. This paper is aimed at showing Hobbes's contribution to the notion of quality between men and women, in opposition to Spinoza. In his books Elements of Law and De Cive, Thomas Hobbes challenges the allegation that patriarchal authoritarism and inequality between men and women are laws of nature. He assents the conventional character of women's submission, and contends tha the family functions under the same operational rule as the Stares: Agreement. This Hobbesian position seems to have had little echo arnong later philosophers, being Spinoza the only one who addressed it in order to criticize it .Spinoza opposed the Hobbesian view that inequality between men and women is the result of agreement; bur, perhaps or his own defeat, he accepted that the causes of the difference are education and culture. Since some AI algorithms with high predictive power have impacted human integrity, safety has become a crucial challenge in adopting and deploying AI. Although it is impossible to prevent an algorithm from failing in complex tasks, it is crucial to ensure that it fails safely, especially if it is a critical system. Moreover, due to AI’s unbridled development, it is imperative to minimize the methodological gaps in these systems’ engineering. This paper uses the well-known Box-Jenkins method for statistical modeling as (...) a framework to identify engineering pitfalls in the adjustment and validation of AI models. Step by step, we point out state-of-the-art strategies and good practices to tackle these engineering drawbacks. In the final step, we integrate an internal and external validation scheme that might support an iterative evaluation of the normative, perceived, substantive, social, and environmental safety of all AI systems. Genetic and early environmental factors are interwoven in the etiology of Borderline Personality Disorder (BPD). Epigenetic mechanisms offer the molecular machinery to adapt to environmental conditions. There are gaps in the knowledge about how epigenetic mechanisms are involved in the effects of early affective environment, development of BPD, and psychotherapy response. We reviewed the available evidence of the effects of psychotherapy on changes in DNA methylation and conducted a pilot study in a sample of 11 female adolescents diagnosed with BPD, (...) exploring for changes in peripheral DNA methylation of FKBP5 gene, which encodes for a stress response protein, in relation to psychotherapy, on symptomatology and underlying psychological processes. For this purpose, measures of early trauma, borderline and depressive symptoms, psychotherapy outcome, mentalization, and emotional regulation were studied. A reduction in the average FKBP5 methylation levels was observed over time. Additionally, the decrease in FKBP5 methylation observed occurred only in those individuals who had early trauma and responded to psychotherapy. The results suggest an effect of psychotherapy on epigenetic mechanisms associated with the stress response. The finding that epigenetic changes were only observed in patients with early trauma suggests a specific molecular mechanism of recovery. The results should be taken with caution given the small sample size. Also, further research is needed to adjust for confounding factors and include endocrinological markers and therapeutic process variables. (shrink)

(...) For many, it was anxiety and uncertainty that “knock[ed] at the door”; for others, however, those same feelings of unease prompted one of hopefulness: reflecting on the possibilities for resilience and regeneration in the process of changing our vision of the world.1 The Knock at the Door conference brought contemporary utopianism to the forefront of thinking about how to respond to global crises while remaining attentive to other adversities of daily life. Scholars and artists answered the knock in an attempt to examine paths toward utopia, and to take advantage of the regenerative and resilient potential of the present.The conference was the culmination of author/activist Larissa Lai’s fellowship period at the University of Huelva. The 2022–23 María Zambrano Fellowship for the academic year2 allowed Lai to complete the project “Utopian Dreams for Post-Covid Times,” carried out in collaboration with the Huelva research group led by Professor Pilar Cuder-Domínguez, who hosted a number of online and in-person seminars on speculative fiction with Lai. The Knock at the Door conference, marking the end of Lai’s fellowship, created yet another space for scholars, artists, and critics to discuss the potential of utopian narratives. Lai asks: “What does our cultural moment require, and how can we get where we need to go from where we are? How can literature, especially speculative fiction literature, help us get from here to there?”3 [End Page 641] The intention of the conference was to encourage others to continue Lai’s work on how to imagine futures where human and posthuman beings need to remain vigilant to adversities. Utopian scholars, among others, might find the complications of “getting there from here” closely related to Lai’s conception of “insurgent utopias,” or “emergent insurgency.” They could find Lai’s concept of “insurgent utopianism” interesting as it lays the foundations of futurity in terms of crisis responses.The aim of the conference was to explore the imagination of better futures through utopian thinking and practice. It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . I am referring to the interdisciplinary research group Histopia, which has its base in Madrid́s Autónoma (...) University, is comprised of twenty-seven researchers from different institutions, and is coordinated by historian Juan Pro. As the name Histopia suggests, it was founded by historians. From the beginning there have been people from other fields, such as political science, architecture, cultural studies, and art history. The aim was always understanding utopianism beyond the study of texts, and centering research in everything that utopianism produces, such as social movements, political programs, and urban programs. In this sense, a premise was to understand utopias not as a footnote in history or a series of eccentric events, but as a guiding force that drives a [End Page 510] history. This placing of utopianism in history was clearly announced in the grouṕs website:Histopia seeks to go beyond the philological approach that predominates in Utopian Studies and to historicize the study of contemporary utopias and dystopias, showing how they respond to the contexts in which they arise, since they reflect the problems and frustrations of a society as well as the aspirations for change it contains, and the conditions of possibility that a particular cultural and emotional framework offers for developing them.1Together with this focus on history, which departs from the more text-centered traditions of an important part of utopian studies, the other main particularity of Histopia is its decentralizing of utopian studies towards the Spanish-speaking world. In this article, the authors bring two personal journeys together: one author’s liberationist journey, sparked by a search for justice and liberation in the slums of Guatemala City, and the other’s lifelong commitment to practical theology and spatial justice in South Africa. A practical theology of liberation is the result of life experiences in countries of the Global South amidst the search for justice and liberation. The worlds that come together in this article are René Girard’s mimetic theory, liberation theology (...) and practical theology. This article raises the question of the cross-contextuality of practical theology and the theological application of mimetic theory to develop innovative theological methodologies that respond to the collective woundedness of the urban context in the Global South.Contribution: The main contribution of this article is the use of three seemingly different theological approaches in conjunction. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. Voluntades anticipadas: desafíos éticos en el cuidado del paciente Diretivas antecipadas de vontade: desafios éticos no cuidado do paciente Advance healthcare directives are intended for the individual to personally express their will and preferences about healthcare and treatment ahead of time. This literature review aims to describe the concept and structure of advance directives and the ethical aspects involved in patient care. Using the keywords “Advance Healthcare Directive” AND “Ethical Implication” and its Spanish equivalents, five databases were accessed: ProQuest, Philosophy, (...) PubMed, Web of Science and Scielo. Publications were narrowed down to the 2010-2018 period. Thirty-one articles were obtained and read critically. Results of this review were grouped into the following categories: concept, structure, clinical situations in which advance directives apply, strengths and limitations, as well as the ethical aspects involved. End of life-related experiences in which a person loses their ability to make decisions and cannot express their wishes, so it is impossible to know their will, are more common nowadays. Most health workers are not appropriately trained in the preparation and application of advance directives, which becomes an opportunity to research and delve deeper into the subject. Advance directives are a tool that gives health workers reliable information on a patient’s values and wishes, so it is vital to train them to provide respectful quality care. Revisamos los problemas éticos en el ensayo _Evaluation of XIENCE versus Coronary Artery Bypass Surgery for Effectiveness of Left Main Revascularization_ (EXCEL), que comparó el intervencionismo coronario percutáneo frente a la cirugía de revascularización en la enfermedad del (...) tronco coronario izquierdo con un SYNTAX score ≤32. Preocupaciones sobre la metodología, actividades asociadas a la veracidad de los datos, y conducta inapropiada durante la investigación son advertidas en este estudio de caso. En este artículo defiendo que la teoría del conocimiento de Schopenhauer impulsó históricamente la idea de que al menos un objetivo de la investigación científica estriba en la exploración tenaz y creativa del potencial heurístico de un sistema teórico, de una matriz disciplinar o de un programa de investigación científica. Sostengo que en ella también se origina una ambigüedad en el significado de (...) los conceptos de descubrimiento objetivo e innovación epistémica.: Little research has been done on Schopenhauer’s influence on twentieth-century philosophy of science. This article defends the thesis that Schopenhauer’s epistemology historically promoted the idea that at least one of the objectives of epistemic research is the tenacious and creative exploration of heuristic potential of a theoretical system, a disciplinary matrix and a scientific research program. I further state that his theory of science leads to ambiguity about the meaning of concepts such as objective discovery and epistemic innovation. (shrink)

This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)

In this paper, I accomplish a conceptual task and a historical task. The conceptual task is to argue that (1) Einstein’s Principle of Separability (henceforth “separability”) is not a supervenience principle and that (2) separability and entanglement are compatible. I support (1) by showing that the conclusion of Einstein’s incompleteness argument would still follow even if one assumes that the state of a composite system does not supervene on the states of the subsystems, and by showing that what Einstein says (...) in “Quantum Mechanics and Reality” (1948) strongly suggests that separability is not a principle about how subsystem states relate to the state of composite systems. I support (2) by showing that if separability was incompatible with entanglement, then Einstein’s argument would be incoherent in a trivial way. Thus, by arguing for (1) and (2) I directly challenge what has been, and still is, a very common reading of separability. The historical task is to offer the first detailed review of the different ways in which separability has been defined by physicists and philosophers in the last 60 years. Among other things, such a review distinguishes three different definitions of the principle, and shows that since the 1990s and up until the present date, it became standard to take separability (as presented by Einstein) to be a supervenience principle. Consensus in the contemporary philosophical literature has it that conserved quantity theories of causation such as that of Dowe [2000]—according to which causation is to be analysed in terms of the exchange of conserved quantities (e.g., energy)—face damning problems when confronted with contemporary physics, where the notion of conservation becomes delicate. In particular, in general relativity it is often claimed that there simply are no conservation laws for (say) total-stress energy. If this claim is correct, it is difficult to see (...) how conserved quantity theories of causation could survive. In this article, we resist the above consensus and defend conserved quantity theories from this conclusion, at least when focusing on the apparent problems posed by general relativity. We argue that this approach to causation can continue to be defended in general relativity, once one appreciates (a) the availability of approximate symmetries in generic general relativistic spacetimes, and (b) the role of modelling and idealisation in that theory. Given these points, conserved quantity theories of causation must stand or fall on other grounds. (shrink)

RESUMEN El artículo ingresa en la ontología del acontecer y recorre cuatro momentos. En primer lugar, distingue la visión del mundo en general, propia de la llamada “metafísica” de la visión del ser como acontecer, y busca un diálogo entre la perspectiva del ser en la metafísica y ontología de Hans-Georg Gadamer. En segundo lugar, analiza la estructura del acontecer o el modo como se despliega el movimiento del sentido, para determinar la lógica de la pregunta como estructura del acontecer. (...) En tercer lugar, entabla un diálogo entre la idea de acontecer y la categoría de finitud, para evidenciar que, cuando se piensa en una ontología del acontecer, esta remite a la determinación de la finitud. Y, finalmente, plantea algunas líneas de desarrollo para profundizar en esta investigación. ABSTRACT The articles discusses the ontology of the event and covers four moments. First, it identifies the general worldview typical of the “metaphysics” of being as event, and seeks to establish a dialogue between the perspective of being in Hans-Georg Gadamer’s metaphysics and his ontology. Secondly, it analyzes the structure of the event or the way in which the movement of meaning unfolds, in order to determine the logic of the question as structure of the event. Third, through a dialogue between the idea of event and the category of finitude, the article shows that thinking the ontology of the event leads to the determination of finitude. Finally, the article suggests a few lines of inquiry for further in-depth research of this topic. (shrink)

Although formal analysis provides us with interesting tools for treating Curry’s paradox, it certainly does not exhaust every possible reading of it. Thus, we suggest that this paradox should be analysed with non-formal tools coming from pragmatics. In this way, using Grice’s logic of conversation, we will see that Curry’s sentence can be reinterpreted as a peculiar conditional sentence implying its own consequent.

Providing meaningful and actionable explanations for end-users is a situated problem requiring the intersection of multiple disciplines to address social, operational, and technical challenges. However, the explainable artificial intelligence community has not commonly adopted or created tangible design tools that allow interdisciplinary work to develop reliable AI-powered solutions. This paper proposes a formative architecture that defines the explanation space from a user-inspired perspective. The architecture comprises five intertwined components to outline explanation requirements for a task: (1) the end-users’ mental models, (...) (2) the end-users’ cognitive process, (3) the user interface, (4) the Human-Explainer Agent, and (5) the agent process. We first define each component of the architecture. Then, we present the Abstracted Explanation Space, a modeling tool that aggregates the architecture’s components to support designers in systematically aligning explanations with end-users’ work practices, needs, and goals. It guides the specifications of what needs to be explained (content: end-users’ mental model), why this explanation is necessary (context: end-users’ cognitive process), to delimit how to explain it (format: Human-Explainer Agent and user interface), and when the explanations should be given. We then exemplify the tool’s use in an ongoing case study in the aircraft maintenance domain. En los más disímiles contextos universitarios, se generan hoy programas para mejorar los desempeños de los docentes en el proceso formativo; pero, infortunadamente estos no siempre resultan en un mejoramiento de la práctica cotidiana de las universidades, sobre todo en la calidad de la formación de los profesionales. De este hecho, el propósito del presente artículo está dado en realizar una valoración de las principales influencias epistemológicas en lo relativo a la profesionalización del docente universitario y develar aquellos desempeños idóneos (...) esenciales que deben poseer en este nivel de educación como expresión de las competencias que deben desarrollar. Today, in most diverse university contexts, programs are developed to improve the performance of professors in the educational process; but unfortunately, they do not always result in improving the daily practice of universities, especially in the quality of professionals training. Of this fact, the purpose of the present article is to carry out a valuation of the main epistemological influences related to the professionalization of universities` professors; and to determine the main essential suitable performances these professionals should have as an expression of the competences they must develop. La tesis principal que aquí se defiende es que, para Popper, la validez del conocimiento estuvo vinculada siempre a la dimensión pragmática del contexto de descubrimiento (e incluso dependía de ella). Constituye, pues, un error afirmar que, para él, 1) dicha validez estaba ligada a un "empirismo encubierto" (opuesto a la tesis sobre la carga teórica de toda observación), según lo ha planteado Ana Rosa Pérez Ransanz, y que 2) en sus ideas, los factores pragmáticos carecían de importancia epistemológica, como (...) lo ha afirmado Ambrosio Velasco. Para justificar esta tesis, se examinan tres argumentos expuestos en The Logic of Scientific Discovery, enfatizando el que se refiere al carácter disposicional de los términos con los que, para Popper, se formulan los enunciados descriptivos. The main thesis I assert here is that for Popper validity of knowledge was always linked to (and even supported by) the pragmatic dimension of the context of discovery. I hold it's wrong to claim that for this author 1) validity of knowledge was linked to a "hidden empiricism" (opposed to the theory-laden character of observation), such as Ana Rosa Pérez Ransanz had propounded, and 2) pragmatic issues were epistemologically irrelevant in his philosophy, such as Ambrosio Velasco has argued. To justify my thesis I examine three arguments exposed in The Logic of Scientific Discovery, emphasizing especially Popper's argument about the dispositional character of the concepts in which descriptive statements are formulated. This paper aims to show that truth is neutral with respect to metaphysics and epistemology. In other words, the paper states that in order to make an analysis about our daily use of truth discourse, it is not necessary to refer to neither the nature of the world nor the nature of our epistemic capacities. The text is composed by three sections. In the first one, it makes explicit the common-sense intuitions which seem to bring truth to either metaphysics or (...) epistemology. In the second one, the text analyzes the role of the predicate «is true» in our natural languages. In the third section, the intuitions aforementioned are considered with the purpose of examining its intuitive status and its alleged relationship with both metaphysics and epistemology. (shrink)

El presente artículo busca señalar la existencia de dos conflictos, al menos, que se presentan en Colombia. El primero es un conflicto directo mayoritariamente sufrido en zonas rurales. El segundo es un tele-conflicto. De su raíz griega es un conflicto que se vive desde lejos (tele). Este último, si bien es virtual, produce efectos reales en los sujetos con un alto poder de decisión, especialmente en zonas urbanas. Con ello se busca señalar el rol de los medios como condición de (...) posibilidad para la existencia del conflicto, pero no sólo debido al uso (abuso) que se pueda dar de ellos para la continuación del conflicto, sino por la misma manera en que es medializado. Para ello se analiza como caso empírico la refrendación de los acuerdos de paz de La Habana entre el estado colombiano y la guerrilla de las FARC-EP. Para ello se hará un análisis fenomenológico de la manera en que los medios interactúan con el sujeto. Con ello se busca observar el rol constitutivo de los medios de la experiencia humana. Con este punto como pivote, se señala la existencia de los dos conflictos previamente nombrados. (shrink)

This paper analyzes the treatment given by Hume and Popper to the problem of induction, and questions the supposed Popper’s overcoming of such problem. In order to do this, it was divided into three main parts: First, Hume’s treatment to the problem of induction —that is, the psychological perspective—; second, Popper’s scientific-objective perspective, and third, a balance of the problem stated under the observation that both approaches are essentially grounded on a different conception of knowledge acquisition.

In Mexico, the Productive Organization Program for Indigenous Women (POPMI) seeks the empowerment of productive capacities in indigenous women. Our study analyzes POPMI outreach, focusing our attention on women beneficiaries who present a high degree of social exclusion and multidimensional poverty in the State of Veracruz. In the study area, the 542 indigenous women benefited in POPMI, presented a condition of multidimensional poverty and a degree of social exclusion: very high, high and medium, they represent only 22.19% of the total (...) beneficiaries of this program In 2010, since at the state level a total of 2,243 indigenous women were cared for. The results show that the localities where the condition of multidimensional poverty and very high, medium and high levels of social exclusion have been excluded in the coverage of POPMI. (shrink)

A lo largo de la historia el ser humano ha sentido interés por el fenómeno del movimiento y su vínculo con la ilusión de vida; diferentes mecanismos y sistemas articulados se han construido con el fin de insuflar vida en seres inertes. El presente artículo reflexiona sobre la cualidad móvil del acto creador presente en diferentes campos socioculturales, desde el misticismo hasta los avances tecnológicos. Se parte del enigma del anima, y su conexión con los creadores, denominados ejecutantes y sus (...) creaciones, denominadas “avatares encarnados”. Se analizan las relaciones de control-libertad, dependencia-independencia entre el ejecutante y su “avatar encarnado”; como también el grado de aceptación que tiene la audiencia al ver las creaciones reproducidas bajo el dispositivo diacrónico. La transición del autómata al personaje animado constata la evolución de los sistemas de representación y reconocimiento del movimiento. (shrink)

En el trabajo "El mérito ejecutivo de fa póliifi de seguro y sus implicaciones frente al proceso rjecutivo", se busca responder la siguiente preglli11ta problemática: ¿Cuáles son las condiciones y límites para que la póliza de seguro se constituya en fundamento para la satisfacción de un derecho cierto por vía del proceso ejecutivo? En el desarrollo del ensayo se considera que la póliza de seguro, en los términos dispuestos por el artículo 1053 del Código de Comercio, se constituye en un (...) evento especial por el que se posibilita la ejecución, aunque no se cumplan los requisitos consagrados en el artículo 488 del Código de Procedimiento Civil. En el trabajo se presenta un cuestionamiento crítico frente a la regulación existente sobre el carácter ejecutivo de la póliza de seguro. Se estudian las connotaciones especiales del artículo 1053 del Código de Comercio frente a la regla general de los títulos ejecutivos del artículo 488 del Código de Procedimiento Civil. Adicionalmente, se establecen parámetros para entender cuándo la aseguradora ha objetado de manera seria la reclam.ación, y acerca de los cómputos frente al plazo que se tiene para objetar. Se consideran las ventajas y deficiencias del proceso ejecutivo para.obtener la satisfacción del derecho del asegurado o beneficiario en los eventos del artículo 1053 del Código de Comercio. De otro lado, se analizan las implicaciones surgidas del silencio de los aseguradores que dentro del plazo legal no objetan las reclamaciones realizadas. Finalmente, se delimitan los problemas que surgen en el proceso de ejecución, desde un perfil teórico procesal, teniendo en cuenta el postulado constitucional del debido proceso. (shrink)

El recurso de amparo en España es la principal garantía jurisdiccional para la protección dederechos definidos como fundamentales por la Constitución frente a actos concretos de las autoridades públicas y secundariamente de particulares. En este estudio se reflexiona sobre el referido mecanismo de tutela reforzada y privilegiada existente en el país europeo. El amparo constitucional es una garantía que sólo es posible considerar frente a aquellos derechos que en España se comprenden como fundamentales, no incluyendo numerosos derechos constitucionales o derechos (...) humanos que no se ajustan a la referida categoría conceptual.El Tribunal Constitucional se constituye en la sede básica para la resolución del amparo considerado como un recurso extraordinario, excepcional y subsidiario de protección de derechos fundamentales. Aunque sus sentencias de amparo resuelven casos concretos, sus motivaciones o consideraciones contienen parámetros para la interpretación de los referidos derechos, vinculando los poderes públicos frente a un razonamiento que pasa a tener un valor erga omnes.En este ensayo se busca contribuir, en cuanto a derecho comparado, en el estudio de las vecindades y diferencias del amparo con la acción de tutela en el caso colombiano.
